These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "Server Administrator") and Aditya Singhal (operating individually and online as @thespen, referred to as "Developer", "we", "us", or "Dexel").

By inviting Dexel ("the Bot") to a Discord server, executing slash commands, accessing the web dashboard at dexel.is-a.bot, or otherwise utilizing any related service, software, or API, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately remove the Bot from your Discord servers and cease all access to the web dashboard.

You represent and warrant that you are at least 13 years of age (or the minimum legal age of digital consent required in your country of residence, such as 16 years of age in certain European Union jurisdictions) in strict accordance with the Discord Terms of Service.

Dexel does not knowingly operate or provide services to individuals under the age of 13. If we discover that a user under the legal age is accessing Dexel or maintaining records in our database, we reserve the right to immediately terminate access and purge associated data.

All users must comply with Discord's official Terms of Service and Community Guidelines at all times while interacting with Dexel.

Dexel provides autonomous multi-turn conversational AI reasoning, voice transcription, text-to-image synthesis, server moderation logging, ticket workflows, virtual economy, community games, and external webhook feed distribution.

Daily Token Accounting: AI reasoning and generation capabilities are governed by strict daily token quotas calculated and reset daily at 00:00 UTC:

• Standard Tier (Default): 500,000 AI tokens per user (1,000,000 shared server pool) per calendar day.
• Premium Tier: 5,000,000 AI tokens per user and server pool per calendar day.

"AS-IS" and "AS-AVAILABLE" Provision: Dexel and its associated services are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We do not guarantee uninterrupted uptime, 100% server availability, zero latency, error-free code execution, or permanent data preservation.

Dexel utilizes autonomous Large Language Models (LLMs) and multi-step reasoning frameworks. AI outputs are non-deterministic, generative, and may occasionally generate inaccurate facts, biased assertions, unintended responses, or hallucinations.

Zero Liability for AI Outputs: Under no circumstances shall the Developer or Dexel be held liable for any damages, losses, disciplinary actions, legal liabilities, or misunderstandings resulting from:

• Any statement, advice, code, calculation, or generated text provided by the AI.
• Automated moderation decisions, user warnings, ticket triage summaries, or ban recommendations initiated via AI models.
• Any reliance placed on AI outputs for financial, medical, legal, structural, or professional advice. Dexel is not a professional advisor.

Users and server staff acknowledge that they retain sole responsibility for evaluating and verifying all outputs generated by Dexel prior to taking action.

Dexel provides real-time speech-to-text audio transcription via the /transcribe command utilizing Groq Whisper models.

Ephemeral RAM Processing: Voice audio packets captured in Discord voice channels are streamed ephemerally into volatile memory (RAM) strictly for the duration necessary to transcribe speech into text. Raw voice audio recordings are never stored on persistent disk or written to permanent databases.

Consent Responsibility: The user initiating the /transcribe command and the server administration bear sole legal responsibility for obtaining all necessary two-party, all-party, or local wiretapping and audio recording consent from every participant present in the voice channel before activating transcription.

Dexel provides synthetic image generation capabilities through /imagine utilizing FLUX and third-party diffusion architectures.

Zero Copyright Claim by Dexel: Dexel and the Developer claim zero proprietary copyright or intellectual property ownership over synthetic image assets generated by users through the service. To the fullest extent permitted by applicable law, generated outputs are provided on a non-exclusive basis and enter the public domain.

Prohibited Image Prompts: You agree not to generate, attempt to generate, or solicit images depicting child sexual abuse material (CSAM), non-consensual sexual imagery (NCII / deepfakes), extreme graphic violence, hate speech, or content infringing third-party trademarks.

Dexel features an integrated virtual economy system (including wallet balances in user_economy, daily currency, activity points, and counting game scores).

Zero Monetary Value: All virtual coins, activity points, experience levels, and leaderboard stats are purely decorative, virtual units of account with zero real-world monetary, fiat, or cryptocurrency value. They cannot be redeemed, refunded, or converted into fiat currency, gift cards, or physical goods under any circumstances.

User-to-User Trading: While users may trade virtual balances with other Discord members at their own discretion, Dexel provides no escrow, transaction verification, or dispute resolution. The Developer is not responsible for lost balances, scams, or fraudulent trades between users.

Users may purchase and activate Dexel Premium server slots for $6.99 USD / month or $69.00 USD / year (or ₹699 INR / month or ₹6,900 INR / year) per slot via Dodo Payments (Merchant of Record for worldwide card, digital wallet, and localized payment rails including UPI).

7-Day Refund Policy: Payments made for Dexel Premium slots are eligible for a full refund within seven (7) calendar days of the initial transaction upon submitting a written refund request with valid proof of payment to adityaweb101@gmail.com. After seven (7) days from the payment date, all payments become final, non-refundable, and non-prorated.

Slot Portability & Reassignment: A premium user may reassign their active slot from one Discord server to another server via the web dashboard at any time. If a server holding an active slot is deleted or blacklisted, the slot owner retains the right to assign that slot to another valid server.

Dexel provides automated audit logging (AutoLog with 18 event hooks), ticketing, and moderation utilities (/ban, /kick, /timeout, /warn, /slowmode).

Third-Party Action Immunity: The execution of any moderation command or rule enforcement is solely the action of the Discord server staff executing the command. Dexel acts strictly as a communication tool between Discord's API and the server. The Developer accepts zero liability for wrongful bans, false kicks, accidental server deletions, or disputes between guild staff and community members.

We reserve the unconditional right, at our sole discretion and without prior notice or explanation, to:

• Blacklist, block, or revoke bot access for any Discord user, guild, or client.
• Reset, wipe, or recalibrate any user's virtual economy balance, activity points, or counting game scores if obtained through macro scripts, self-bots, API exploits, or system glitches.
• Suspend or terminate web console access for accounts engaging in abusive API requests or unauthorized automated traffic.

These Terms of Service and any dispute, controversy, or claim arising out of or relating to them shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any legal action or proceeding shall be subject to the exclusive jurisdiction of the competent courts of India.
